Richmond, VA ( – The ACLU of Virginia has sent letters to sheriffs and jail authorities in the Commonwealth, warning them about following ICE detainers.  Immigration and Customs Enforcement often sends requests to hold people they suspect of being in the country illegally, so they can get more time to investigate.


The ACLU says without an additional warrant, the requests are unconstitutional.  A person cannot just be held because they are suspected of being in the country illegally.  The civil rights group says constitutional provisions apply to both citizens and non-citizens inside the country.


The letter was sent out at the end of July.
